LEDownia.pl is an online store and trading brand operated by LF Sp. z o.o. These Terms and Conditions define the rules for using the store, placing orders, payments, delivery, complaints, withdrawal from the contract, use of the electronic “Withdraw from contract here” function and the basic rules for personal data processing.

2. Definitions

  • Seller — LF Sp. z o.o., ul. Władysława IV 20A, 80-547 Gdańsk, Poland, Tax ID / NIP: 583-326-74-68, KRS: 0000698089, REGON: 368433797.
  • Store — the LEDownia.pl online store available at www.ledownia.pl.
  • Customer or Buyer — a natural person, legal person or organisational unit purchasing products or using the store.
  • Consumer — a natural person making a purchase not directly related to their business or professional activity.
  • Entrepreneur with consumer rights — a natural person conducting business activity who enters into a contract directly related to that business, provided that the contract is not of a professional nature for that person.
  • Product — goods, services or solutions offered in the store, in particular LED products, LED power supplies, LED strips, controllers, profiles, lamps, components or made-to-order products.
  • Withdrawal function — the electronic function available in the store under the name “Withdraw from contract here”, enabling the Customer to submit a withdrawal statement through the store interface.

3. Scope of store activity

The store conducts online sales of products available in the LEDownia.pl offer, in particular LED lighting, LED power supplies, LED strips, controllers, LED profiles, components for luminaire construction, lamps, LED mirrors and solutions prepared for specific applications.

The store may also provide technical information, product descriptions, guides and data helpful in choosing appropriate lighting solutions.

4. Electronically supplied services

Through the store, the Seller provides electronically supplied services free of charge, in particular: enabling browsing of store content, placing orders, operating a Customer account, using the cart, contact and complaint forms, the electronic withdrawal function and — if available and requested — the newsletter.

To use the store, the Customer needs a device with Internet access, an up-to-date web browser, an active e-mail account and cookies and JavaScript enabled to the extent necessary for the cart, account and forms to work properly.

It is prohibited to provide unlawful content, interfere with the operation of the store, bypass security measures, use another person’s account without authorisation or provide false data.

The contract for electronically supplied services consisting in browsing the store is concluded when the Customer starts using the store and terminates when the Customer leaves it. The contract concerning the Customer account is concluded when the account is created and may be terminated at any time by sending a request to delete the account to bok@ledownia.pl, subject to retaining data necessary to comply with legal obligations, handle orders, complaints, returns, withdrawals from the contract or pursue claims.

Complaints concerning the operation of electronically supplied services may be submitted to bok@ledownia.pl. The submission should preferably include a description of the problem, the date on which it occurred, the device or browser used and contact details.

Typical risks related to the use of electronically supplied services include, among others, unauthorised access to an account, phishing, malware, technical interruptions and the risk of using an unsecured device or network. We recommend using up-to-date software, strong passwords and checking the website address before logging in or making a payment.

5. Placing orders and concluding the contract

  • Orders may be placed through www.ledownia.pl.
  • Product information presented in the store does not constitute an offer within the meaning of the Polish Civil Code, but an invitation to conclude a contract.
  • The Customer places an order by selecting a product, adding it to the cart, providing the required data and selecting the delivery and payment method.
  • After placing an order, the Customer receives an e-mail confirming receipt of the order and its details.
  • The sales contract is concluded when the Seller confirms acceptance of the order.
  • The content of the contract is recorded and made available by sending the order confirmation to the Customer’s e-mail address and by making these Terms and Conditions available on the store website.

6. Prices and product availability

  • Product prices displayed in the store are gross prices, unless otherwise stated next to the product.
  • For the Polish version of the store, prices are generally displayed in Polish zloty. For other language versions, prices may be displayed in another currency if the store provides such functionality.
  • Delivery costs are displayed in the cart before the order is placed.
  • Product availability information is displayed on the product page or during the order process.
  • If a product is not available, the Seller will contact the Customer to agree on further order processing, propose a replacement, change the delivery date or cancel the order and refund the payment.
  • A replacement product may be shipped only after agreement with the Customer.

7. Payments

The Customer may pay using methods available in the store at the time of placing the order, in particular:

  • bank transfer,
  • electronic payment or payment card through payment operators available in the store,
  • cash on delivery, if this method is available for the given order,
  • deferred payment terms, if individually agreed with the Seller.

Processing of an order paid in advance begins after the payment is credited or after the Seller receives confirmation of successful payment authorisation. In the case of cash on delivery, order processing begins after the order is accepted by the Seller.

8. Delivery

  • The store delivers within Poland and to selected European countries.
  • Available delivery methods depend on product dimensions, shipment weight, delivery address and current logistics options.
  • Delivery may be carried out by courier companies, to pickup points and to parcel lockers, if the given method is available for the order.
  • The standard dispatch time for products marked as available is usually 1–2 business days, unless a different time is stated on the product page.
  • Made-to-order, non-standard, cut-to-size, configured or personalised products may require a longer processing time stated in the product description or agreed individually with the Customer.
  • Delivery cost is calculated in the cart before the order is placed.
  • After dispatch, the Customer will receive a tracking number if the carrier provides such a service.

9. Receiving the shipment and transport damage

The Customer should check the condition of the shipment upon receipt or immediately after collection from a pickup point or parcel locker. If the packaging is damaged or the contents raise concerns, it is recommended to prepare a damage report with the carrier and contact the Seller.

Lack of a damage report does not deprive the Consumer of statutory rights, but may make the complaint procedure with the carrier more difficult or longer.

10. Complaints — conformity of goods with the contract and warranties

The Seller is liable towards the Consumer and the Entrepreneur with consumer rights for the conformity of goods with the contract under applicable law.

In the case of lack of conformity of goods with the contract, the Customer may first request repair or replacement. A price reduction or withdrawal from the contract may be available in the cases provided by law, in particular if bringing the goods into conformity is impossible, excessively costly, has not been completed within a reasonable time or the lack of conformity is significant.

A complaint may be submitted by e-mail to: bok@ledownia.pl.

The complaint should preferably include:

  • order number,
  • name and contact details,
  • product name or index,
  • description of the problem,
  • photos or videos documenting the defect, if possible,
  • expected method of resolving the complaint, in particular repair, replacement, price reduction or withdrawal from the contract, if such request is available under applicable law.

The Seller will respond to a Consumer complaint within 14 days from the date of receiving it. If returning the product is necessary to process the complaint, the Seller will provide the Customer with appropriate instructions.

Some products may be covered by a manufacturer’s, distributor’s or importer’s warranty. A warranty does not exclude, limit or suspend the Consumer’s statutory rights resulting from the conformity of goods with the contract.

11. Withdrawal from the contract

The Consumer and the Entrepreneur with consumer rights have the right to withdraw from a distance contract within 14 calendar days without giving any reason.

The 14-day period starts from the day on which the Customer takes possession of the goods, or, in the case of delivery in batches, from the day on which the last item is received.

To exercise the right of withdrawal, the Customer may submit a clear withdrawal statement:

  • through the electronic withdrawal function “Withdraw from contract here”, available in the store interface, in particular in the website footer, in the customer account and in the order details,
  • by e-mail to bok@ledownia.pl, or
  • in writing to the Seller’s address.

To meet the deadline, it is sufficient to send the withdrawal statement before the 14-day period expires. A model withdrawal form is provided at the end of these Terms and Conditions, but using it is not mandatory.

The electronic withdrawal function allows the Customer to submit the statement through the store website. For secure order identification, the form may require the order number and the e-mail address used for the purchase. The Customer may indicate withdrawal from the entire contract or from part of the order, including selected products and quantities. Providing a reason for withdrawal is not required.

The online process has two steps. After completing the form, the Customer receives a summary of the statement, and the statement is submitted only after using the “Confirm withdrawal from contract” button. After confirmation, the Seller sends the Customer an acknowledgement of receipt of the withdrawal statement to the provided e-mail address, including in particular the content of the statement, the date and time of submission and the case reference.

Receiving the statement through the online function does not automatically approve the return in cases where the right of withdrawal may be excluded by law or where the order or selected products require additional review.

12. Returning goods and refund

After submitting the withdrawal statement, the Customer should return the goods without undue delay, no later than within 14 days from the day of submitting the statement.

The cost of returning goods under the right of withdrawal is borne by the Customer, unless the Seller expressly declares otherwise. The Seller does not accept cash-on-delivery return shipments.

The Seller will refund the payments received without undue delay, no later than within 14 days from the day of receiving the withdrawal statement. The refund also includes the cost of delivery to the Customer corresponding to the least expensive standard delivery method offered by the store for the given order. If the Customer chose a delivery method more expensive than the least expensive standard delivery method, the Seller is not required to refund the additional costs of that more expensive delivery. The Seller may withhold the refund until the goods are received back or until the Customer provides proof of returning them, whichever occurs first.

The refund will be made using the same payment method used by the Customer, unless the Customer expressly agrees to another refund method that does not involve any additional cost for the Customer.

13. Liability for diminished value of goods

The Customer is liable for any diminished value of goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning. This may include in particular installation, cutting, soldering, permanent contamination, mechanical damage, traces of installation or other changes preventing the product from being sold as full-value goods.

14. Exceptions to the right of withdrawal

The right of withdrawal may not apply in cases provided for by applicable law, in particular to:

  • non-prefabricated products manufactured according to the Customer’s specifications or intended to meet the Customer’s individual needs,
  • cut-to-size, configured, personalised or made-to-order products,
  • goods which, after delivery, due to their nature, become inseparably connected with other items,
  • services fully performed with the Customer’s express consent, if applicable law excludes the right of withdrawal in such a case.

If the Customer submits the statement through the online function in relation to a product potentially covered by an exception, the Seller records the statement and confirms its receipt, and then verifies the effectiveness of the withdrawal in accordance with applicable law and the nature of the relevant product.

15. Technical content, descriptions and product photos

Product photos are for illustrative purposes. The Seller makes efforts to ensure that product descriptions, photos and parameters are reliable and up to date. If the Customer has doubts about the product’s application, parameters or compatibility, the Customer may contact the Seller before purchase.

Electrical and lighting products should be installed in accordance with their intended use, technical documentation, safety rules and applicable regulations. If the work requires professional qualifications, it should be performed by an authorised person.

Personal data is processed in accordance with the GDPR and national data protection regulations.

17. Purposes and legal bases of personal data processing

Personal data may be processed in particular for the following purposes:

  • handling the Customer account, if the Customer creates one,
  • accepting and processing orders,
  • handling payments, delivery, returns and complaints,
  • operating the electronic withdrawal function, including order identification, recording the content of the statement, selected products, date and time of submission, case reference number, case status and sending confirmation of receipt of the statement,
  • issuing accounting documents,
  • contacting the Customer regarding an order, enquiry, complaint or withdrawal from the contract,
  • ensuring the security and proper operation of the store, including forms and the Customer account,
  • establishing, pursuing or defending claims,
  • fulfilling legal obligations imposed on the Seller,
  • conducting marketing activities, if the Customer has given consent or if permitted by law.

The legal basis for processing may include, in particular: performance of a contract or taking steps before entering into it, legal obligation imposed on the controller, legitimate interest of the controller, such as contacting the Customer, handling claims and ensuring store security, or the Customer’s consent where consent is required for a given activity.

Providing data necessary to place and process an order, handle payment, delivery, complaint, return or withdrawal from the contract is required to handle the relevant matter. Failure to provide such data may prevent the Customer from placing an order or having the request handled.

The Seller does not make decisions concerning the Customer based solely on automated processing which would produce legal effects concerning the Customer or similarly significantly affect the Customer.

18. Recipients of personal data

Personal data may be transferred to entities supporting the Seller in operating the store, in particular: courier companies, payment operators, accounting, IT, hosting, marketing and service providers, providers of communication tools and form handling tools, as well as entities authorised to obtain data under applicable law.

19. Data retention period

Personal data is stored for the period necessary to achieve the purposes for which it was collected, including order processing, handling returns, withdrawals from the contract, complaints, accounting and tax obligations, and for the limitation period of possible claims. Data processed on the basis of consent is stored until the consent is withdrawn, unless earlier deletion results from applicable law or the purpose of processing no longer exists.

20. Rights of the data subject

The Customer has the right to access their data, rectify it, erase it, restrict its processing, transfer the data, object to processing and withdraw consent if processing is based on consent. To exercise these rights, the Customer may contact the Seller at bok@ledownia.pl.

The Customer also has the right to lodge a complaint with the President of the Personal Data Protection Office if the Customer believes that personal data processing violates applicable regulations.

21. Cookies

The store uses cookies and similar technologies to ensure proper website operation, cart handling, Customer account operation, forms, remembering preferences, compiling statistics and — if the Customer has given appropriate consent — conducting marketing activities.

Cookies necessary for the operation of the store may be used to the extent required to provide electronically supplied services. Other cookies, in particular analytical or marketing cookies, are used in accordance with the Customer’s consent settings if such consent is required.

Cookie settings may be changed in the browser settings or through the consent mechanism available on the website, if such mechanism is provided.

22. Out-of-court dispute resolution

A Consumer may use out-of-court complaint and redress methods, in particular assistance from the competent municipal or district consumer ombudsman, Trade Inspection or information available on the website of the Polish Office of Competition and Consumer Protection.

23. Final provisions

  • Contracts concluded through the store are governed by Polish law, subject to mandatory consumer protection provisions.
  • These Terms and Conditions are available free of charge on the store website in a way that allows them to be obtained, recorded and reproduced.
  • The Seller may amend these Terms and Conditions for important reasons, in particular due to changes in law, store functionality, payment methods, delivery methods or Seller details.
  • Orders placed before a change to these Terms and Conditions are governed by the Terms and Conditions in force at the time of placing the order.
  • In matters not regulated by these Terms and Conditions, applicable law shall apply.

24. Model withdrawal form

This form should be completed and returned only if the Customer wishes to withdraw from the contract. Using this form is not mandatory.
